The Civil Division is one of two divisions in the Sheriff's Office that a Sheriff is mandated to have according to North Carolina General Statutes. The Sheriff or his deputies, are the only law enforcement officers in the state that are authorized to serve civil process. The Civil Division, and the Patrol division of the Caldwell County Sheriffs Office share the responsibility of service of all civil papers that come into the Sheriff's Office. These include Summary Ejectments (evictions), executions, notice of rights, foreclosures, magistrate summons (small claims lawsuits), and many others. Along with the civil papers, the Civil Division serves child support orders and collection of Caldwell County and N.C. Department of Revenue Taxes. The Civil Division is authorized by law to seize property when all other efforts have failed, to satisfy judgments on executions. This property is then sold at auction to recover the money owed. This property could include, but is not limited to, homes, businesses, stocks, bank accounts, livestock, vehicles, and household goods.
